E-Commerce Contract

Purchasing any product from the toshopping.shop online store implies the consumer's agreement with all the terms and conditions of this Product Sales Agreement.

Considering that:

I - toshopping.shop is a company whose main activities consist of intermediating products via the internet;

II - The user is a natural or legal person, duly registered with a correctly completed registration form, whose information has been validated by toshopping.shop ;

III - The user declares that they are acting in good faith and in the full exercise of their civil capacity to enter into this Contract, declaring that they have understood, read and agree to all the terms and conditions set forth herein.

OF THE PURCHASE AND SALE PROCEDURES

Clause One: After placing an order for products in the online store, the user must wait to receive an email notification confirming the requested transaction.

Paragraph one: Toshopping.shop reserves the right not to confirm the purchase and sale in the following cases:

I - User with incorrect or invalid registration information;

II - Deliveries to be made outside the delivery areas made available by toshopping.shop at the time of purchase and sale;

III - Fraud and bad faith, non-compliance with any of the site's terms and policies, abuse of rights, and/or other situations that imply violation of legal provisions or illicit enrichment on the part of the user, and in other cases provided for under applicable law.

Clause Two: The purchase and sale price will be included in the confirmation email, and the user will be offered the payment methods available on the toshopping.shop website at the time of purchase and sale.

First Paragraph: Payment by credit card may not be approved if there is an inconsistency in the cardholder's data.

RIGHTS AND OBLIGATIONS

Return due to buyer's remorse.

Clause Three: Product returns due to buyer's remorse may be made within 7 (seven) calendar days, counted AFTER RECEIPT OF THE PRODUCTS.

Paragraph One: To exercise the right of withdrawal, the user must contact toshopping.shop via the customer service email address toshoppingofficial@gmail.com.

Paragraph Two: After sending the email expressing your regret, the user must wait for our team to contact them, informing them of the necessary procedures for replacing the item or refunding the amounts paid.

Third Paragraph: The return stipulated in this clause will only be approved by toshopping.shop after the following has been verified:

I - The effective return of the product to the supplier's distribution center;

II - Confirmation by toshopping.shop that the product was returned unused, in its original packaging, accompanied by labels, manuals and accessories;

III - Approval of the exchange or return by toshopping.shop 's quality control, after analysis, will be carried out within 10 business days;

Fourth Paragraph: If the user exercises the right of withdrawal in a manner inconsistent with this clause or contract, and/or if any discrepancy or violation is identified in the returned product, the return will not be accepted and we will return the product to the user without prior notice.

EXCHANGE DUE TO PRODUCT DEFECT OR FAILURE

Clause Four: The exchange of products that present a manufacturing defect or flaw may be carried out provided that the request is made within the legal warranty period after receiving the products, in accordance with article 26 of the Consumer Protection Code.

Paragraph One: To request an exchange, the user must contact toshopping.shop via the customer service email address toshoppingofficial@gmail.com.

Paragraph Two: The exchange stipulated in this clause will only be approved by toshopping.shop after the following has been verified:

I - The effective return of the product to the supplier's distribution center;

II - Confirmation by toshopping.shop that the product was returned along with manuals and accessories;

III - Approval of the exchange or return by toshopping.shop 's quality control will be carried out after analysis within 10 business days;

Third Paragraph: If the user exchanges the product in violation of this clause and/or if any discrepancy or damage to the product is identified, the return will not be accepted and the product will be returned to the user without prior notice.

PAYMENT REFUND DEADLINE

Clause Five: If payment was made by credit card, the refund will be processed to the same credit card and will be visible to the user within 2 (two) billing cycles after the refund is completed, which may vary depending on the card's billing date.

DELIVERY TIME AND CONDITIONS

Clause Six: Products are delivered Monday through Friday, from 8:00 AM to 9:00 PM, and the estimated delivery time will only begin after payment confirmation and logistical processing.

First Paragraph: The product delivery service is carried out solely and exclusively by the Postal Service, which is also responsible for meeting the deadlines and completing the delivery stages to the user.

Paragraph Two: Delivery may be made directly to third parties, such as doormen or relatives.

Third Paragraph: Delivery may not be completed within the stipulated timeframe due to:

I - The user's absence at the indicated address;

II - Incorrect registration data;

III - Refusal of the product by the user or a third party;

IV - Regarding the change of address of the user;

V - The occurrence of any force majeure event, such as floods, natural disasters, large-scale accidents, or other events that prevent delivery from taking place;

VI - Regarding strikes or work stoppages at the Post Office;

VII - Due to the significant increase in demand for postal services;

VII - Due to festive periods, such as Christmas and New Year's.

Fourth Paragraph: The delivery time for products is 15 to 45 business days after shipment, according to postal service rules. This timeframe may be extended to up to 90 business days for the reasons expressed in the Third Paragraph of this clause.

Seventh Clause: This contract aims to ensure facilitated customer service, in accordance with item IV of article 4 of Decree No. 7,962/13.

Clause Eight: toshopping.shop reserves the right to cancel the commercial transaction if any situation is identified that constitutes fraud, bad faith, breach of any of the site's terms and policies, abuse of rights, and/or other situations that imply violation of legal provisions or illicit enrichment.

Clause Nine: The relationship between toshopping.shop and the user is governed exclusively by the conditions set forth in this contract.

FORUM

Clause Ten: The jurisdiction for resolving any issue pertaining to this contract shall be that of the consumer's domicile.
